LLC or Corporation

Whereas in cooperatives, employees own the business directly, in an EOT structure, a special type of trust is the legal owner of the business. Nonprofit 501(c)(3)
The process to start a nonprofit involves forming a nonprofit corporation in New Mexico and requesting tax-exempt status from the IRS. Depending on the facts of your proposed nonprofit, requesting tax-exempt status will require filing Form 1023 (40 pages) or Form 1023-EZ (3 pages). Our attorney will file your Articles of Incorporation with the state, obtain a federal tax ID (EIN) for you, draft your bylaws, and file the correct form requesting tax-exempt status from the IRS.
